- PRIMERO. CONFIRMAR, en los terminos senalados en esta providencia, la sentencia del Juzgado Cincuenta y nueve Penal Municipal de Santafe de Bogota, de fecha junio veintitres (23) de mil novecientos noventa y tres (1993), que denego la tutela solicitada por XX.
- SEGUNDO. REVOCAR, en los terminos y por las razones expuestas en los considerandos de esta providencia, las sentencia de septiembre 21 de 1993, proferida por la Sala de Familia del Tribunal Superior del Distrito Judicial de Santafe de Bogota y la sentencia de diciembre 9 de 1993, proferida por la Sala de Casacion Civil de la Corte Suprema de Justicia.
- TERCERO. ORDENAR, en guarda del derecho de la intimidad de la familia, que en toda publicacion de la presente decision, se omitan sus nombres.
- CUARTO. LIBRAR comunicacion al Juzgado Cincuenta y Nueve Penal Municipal y a la Sala de Familia del Tribunal Superior del Distrito Judicial de Santafe de Bogota, para que de conformidad con lo dispuesto por el articulo 36 del decreto 2591 de 1991, notifique esta sentencia a las partes y adopten las decisiones necesarias para adecuar su fallo a lo dispuesto por esta Sala.
