- PRIMERO. CONFIRMAR la sentencia del Tribunal Superior del Distrito Judicial de esta ciudad, Sala Penal, de 26 de octubre de 1993, pero solamente en lo que se refiere al derecho de petición. En consecuencia, se concede la tutela demandada por la señorita EYICETH AVENDAÑO CURACA frente a tal derecho.
- SEGUNDO. REVOCAR la condena en abstracto al pago de perjuicios, y la orden de enviar copia íntegra del fallo de primera instancia, al Instituto Colombiano de Fomento a la Educación Superior - ICFES-.
- TERCERO. Comunicar la presente sentencia al Juzgado 74 Penal del Circuito, de esta ciudad, para que sea notificada a las partes, de conformidad con lo dispuesto en el artículo 36 del decreto 2591 de 1991. Así mismo, al Instituto Colombiano de Fomento a la Educación Superior - ICFES-.
