- PRIMERO. CONFIRMAR la sentencia proferida por el Tribunal Superior del Distrito Judicial de Cundinamarca -Sala Penal- del siete (7) de diciembre de 1992. En consecuencia se deniega la acción de tutela instaurada por el señor Juan Ricardo San Francisco de Asís Escobar Bonitto.
- SEGUNDO. PREVENIR al Tribunal Superior del Distrito Judicial de Cundinamarca para que en lo sucesivo se ABSTENGA de dar trámite de fondo de las acciones de la tutela en las que carezca de competencia, conforme a las motivaciones que se expresaron en esta sentencia.
- TERCERO. Por medio de Secretaría General, INFORMAR del presente fallo a la Procuraduría Delegada para la Vigilancia Judicial, para lo de su competencia.
- CUARTO. COMUNIQUESE la presente decisión al Tribunal Superior del Distrito Judicial de Cundinamarca -Sala Penal-, para que sea notificada a las partes conforme lo dispone el artículo 36 del Decreto 2591 de 1991.
