  1. Primero. REVOCAR el fallo proferido por el Juzgado
  2. Octavo. de Ejecución de Penas y Medidas de Seguridad de Santafé de Bogotá, que negó la tutela impetrada y, en su lugar, CONCEDER a Abelardo Serna Gil la tutela del derecho a la salud.
  3. Segundo. ORDENAR a la Dirección de la Penitenciaría Central de Colombia "La Picota" que, si aún no lo hubiere hecho, permita al interno Abelardo Serna Gil el uso del calentador que requiere para evitar las exacerbaciones de su sintomatología, según el dictamen de la Sección de Sanidad de la Penitencia Central de Colombia La Picota. Dicho calentador debe reunir las condiciones técnicas que a juicio del INPEC sean necesarias para garantizar la seguridad del centro carcelario. Igualmente el peticionario debe adoptar las medidas de seguridad que para el uso de dicho electrodoméstico se requieran, según lo determine dicha entidad.
  4. Tercero. Por Secretaría, líbrese la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
