- Primero. Revocar la sentencia dictada por el Juzgado
- Sexto. Penal Municipal de Popayán Cauca el 27 de julio de 2001, en el proceso de la referencia.
- Segundo. Ordenar al Director de la Oficina de Asuntos Penitenciarios del Instituto Nacional Penitenciario y Carcelario INPEC que, dentro de las cuarenta y ocho (48) horas siguientes a la notificación de esta sentencia, resuelva la solicitud de traslado presentada por el actor el 22 de mayo de 2000, para lo cual el servidor público competente deberá tener en cuenta todos los motivos aducidos por el actor, y notifique legalmente la decisión.
- Tercero. Dar cumplimiento a lo previsto en el artículo 36 del Decreto 2591 de 1991.
