en nombre del pueblo y por mandato de la Constitución,
R E S U E L V E
Primero. REVOCAR PARCIALMENTE el fallo de segunda instancia adoptado por la Sala Civil-Familia del Tribunal Superior del Distrito Judicial de Tunja el 30 de mayo de 2001, en cuanto negó el amparo impetrado contra el Banco Agrario de Colombia.
Segundo. CONFIRMAR, por las razones consignadas en la parte motiva de esta sentencia, el fallo de primera instancia dictado el 6 de abril de 2001 por el Juzgado
Primero. Civil del Circuito de Tunja, mediante el cual se concedió la tutela, como mecanismo transitorio, de los derechos fundamentales a la accionante MYRIAM RIVERO SALCEDO, vulnerados tanto por la empresa Coltempora Ltda. como por el Banco Agrario de Colombia.
Tercero. ORDENAR que por Secretaría General se dé cumplimiento a lo previsto en el artículo 36 del decreto 2591 de 1991.
