- Primero. Revocar la sentencia proferida por la Sala Penal del Tribunal Superior de Bogotá el 13 de junio de 2003.
- Segundo. Tutelar el derecho fundamental que tiene Julio Rodríguez Vargas a que el Juzgado 26 Penal del Circuito no agrave la condena impuesta en primera instancia por el Juez 42 Penal Municipal.
- Tercero. Declarar la nulidad de la sentencia proferida por el Juzgado 26 Penal de Circuito el 11 de marzo de 2003.
- Cuarto. Ordenar al Juzgado 26 Penal de Circuito que al resolver el recurso interpuesto por Julio Rodríguez Vargas limite su decisión al punto de inconformidad planteado por él.
- Quinto. DÉSE cumplimiento a lo dispuesto en el artículo 36 del Decreto 2591 de 1991.
