Primero. REVOCAR las sentencias adoptadas por los Juzgados Catorce Civil Municipal y
Segundo. Civil del Circuito de Barranquilla el 15 de junio y el 13 de septiembre de 2001, para en su lugar RECHAZAR la acción de tutela promovida por el ciudadano ROGELIO GALOFRE MARTÍNEZ a través de apoderado contra la Empresa Distrital de Telecomunicaciones de Barranquilla -ESP-, por las razones consignadas en la parte considerativa de la presente providencia.
Segundo. CONDENAR en costas al demandante ROGELIO GALOFRE MARTÍNEZ. En consecuencia, el Juez Catorce Civil Municipal de Barranquilla, una vez regresen las diligencias a su Despacho, iniciará el procedimiento respectivo para la liquidación y pago de las costas a cargo del demandante, de acuerdo con lo expuesto en precedencia.
Tercero. ORDENAR que, por la Secretaría General de esta Corporación, se compulsen copias de la totalidad del expediente y se remitan a la Sala Jurisdiccional Disciplinaria del Consejo Seccional de la Judicatura del Atlántico, para los fines señalados en la parte motiva de la presente sentencia.
Cuarto. ORDENAR que por la Secretaría General de la Corporación, se libren las comunicaciones previstas en el artículo 36 del decreto 2591 de 1991, para los efectos allí contemplados.
