  1. Primero. REVOCAR el fallo proferido por la Sala Laboral del Tribunal Superior de Bucaramanga, el 28 de Mayo de 2002 y en consecuencia, TUTELAR el derecho de petición del actor.
  2. Segundo. ORDENAR al Instituto de Seguros Sociales que, en el término de 48 horas siguientes a la notificación de esta sentencia, si aún no lo ha hecho, dicte el acto administrativo que resuelva de fondo la petición de la actora, no siendo válida la excusa de que está a la espera del bono pensional.
  3. Tercero. Por ser el Fondo Territorial de Pensiones de Santander la entidad obligada a concurrir con el pago de la pensión de vejez de Héctor Prieto, ORDENAR, si no lo hubiere hecho ya, que en el término de cinco (5) días siguientes a la notificación de este fallo, emita y expida el bono pensional correspondiente.
  4. Cuarto. REMITIR a la Sala Laboral del Tribunal Superior de Bucaramanga copia de las sentencias T- 684 de 2001 y T-1119 de 2001, que resume la doctrina de la Corte Constitucional en materia de derecho de petición y bono pensional.
