- Primero. REVOCAR las sentencias de las Salas de Conjueces de las Salas de Casacion Penal y Civil y Agraria de la Corte Suprema de Justicia, dictadas en el proceso de la referencia, y en su lugar CONCEDER la tutela de los derechos fundamentales a la igualdad y al debido proceso del ciudadano Luis Felipe Colmenares Russo. En consecuencia se ORDENA a la Corte Suprema de Justicia que, en el termino de veinte (20) dias, proceda a nombrar a Luis Felipe Colmenares Russo en el cargo de Magistrado de la Sala Penal del Tribunal Superior del Distrito Judicial de Barranquilla y adoptar las medidas necesarias para el efecto.
- Segundo. ORDENAR que, en caso de no elegir al
- primero. de la lista, mediante decision motivada y basada en razones objetivas que expliquen la no eleccion del primero, se proceda a la eleccion y nombramiento del
- segundo. en la lista suministrada por el Consejo Superior de la Judicatura, y asi sucesivamente.
- Tercero. ORDENAR, tanto al Consejo Superior de la Judicatura, como a la Corte Suprema de Justicia o el Tribunal Superior del Distrito Judicial de Barranquilla segun el caso, que adopten las medidas indicadas en el fundamento 10 de esta sentencia, en favor del ciudadano Rodrigo Jabba Navarro, sin que en ningun caso el termino de reubicacion pudiere exceder de un mes contado a partir de la ejecutoria del acto proferido por la Corte Suprema de Justicia.
- Cuarto. Por Secretaria, librese la comunicacion prevista en el articulo 36 del Decreto 2591 de 1991.
