PRIMERO. Declarar que en la tutela interpuesta por la señora Daisi María Padilla Utria quien actuó como hija en representación de su señora madre María Auxiliadora Utria Yépes se ha presentado un hecho superado y por esta razón exclusivamente se CONFIRMA la sentencia que no concedió la tutela Nº 1007173, proferida por el Juez Diecisiete Civil Municipal, con fecha 9 de julio de 2004.
SEGUNDO. LÍBRESE por Secretaría las comunicaciones de que trata el artículo 36 del Decreto 2591 de 1991, para los efectos allí contemplados.
