- Primero. REVOCAR la sentencia proferida por la Corte Suprema de Justicia, en la acción de tutela instaurada por León Julio Aragón Solano, como agente oficioso de su esposa la señora Gladis Sofía García García, contra el Instituto de Seguro Social por violación del derecho a la salud en conexidad con el derecho a la vida.
- Segundo. CONCEDER la protección del derecho a la salud en conexidad con el derecho a la vida de Gladys Sofía García García. En consecuencia, se ordena al Instituto de Seguro Social que en el término de las cuarenta y ocho (48) horas siguientes a la notificación de la presente providencia, disponga lo necesario, si aún no lo ha hecho, para que se le practique a la señora Gladys Sofía García García, la operación quirúrgica de revascularización miocárdica en la clínica Fundación Cardiovascular del Oriente Colombiano en el Departamento de Santander y se le presten los cuidados necesarios para preservar su vida.
- Tercero. El Instituto de Seguro Social podrá repetir en contra de la subcuenta de enfermedades catastróficas y ruinosas del Fondo de Solidaridad y Garantía del Sistema General de Seguridad Social en Salud
- Cuarto. LÍBRENSE por secretaría las comunicaciones a que se refiere el artículo 36 del decreto 2591 de 1991
