Primero. REVOCAR la sentencia proferida por el Juzgado
Cuarto. Penal del Circuito de Palmira del 22 de septiembre de 1998. En su lugar CONCEDER la presente tutela como mecanismo transitorio por violación de los derechos fundamentales a la vida, seguridad social, salud.
Segundo. ORDENAR al INFIPAL, que en el término de cuarenta y ocho (48) horas contadas a partir de la notificación de la presente sentencia y por un plazo máximo de cuatro (4) meses, proceda a reanudar los pagos de las mesadas pensionales del señor José Granario Palomino en lo que corresponda al mínimo vital, siempre y cuando exista la disponibilidad presupuestal correspondiente. El INFIPAL dispondrá del mismo plazo de cuatro (4) meses para agotar los trámites que permitan asegurar los recursos que garanticen el pago puntual y completo de las mesadas pensionales futuras del demandante. Respecto de las mesadas causadas y no pagadas, y de lo que exceda el mínimo vital, el demandante deberá acudir ante la jurisdicción laboral para reclamarlas allí.
Tercero. LÍBRENSE las comunicaciones de que trata el artículo 36 del Decreto 2591 de 1991, para los efectos allí contemplados.
