- PRIMERO. REVOCAR en su integridad la sentencia proferida por el Juzgado
- Quinto. Civil Municipal de Santa Marta, el 15 de agosto de 2002 y CONCEDER la tutela del Señor Ricardo José Donado Granados para amparar su derecho al debido proceso.
- SEGUNDO. ORDENAR a Electricaribe S.A. E.S.P., si aún no la ha realizado, la reconexión del servicio de energía, alumbrado público y aseo en el inmueble de propiedad del actor dentro de las 48 horas siguientes a la cancelación del valor equivalente a las tres primeras facturas no pagadas por el arrendatario del predio y consumidor del servicio, además de los gastos propios del restablecimiento del servicio.
- TERCERO. ANEXAR copia de la Sentencia T-1225 de 2001 al presente fallo para efectos del artículo 36 del decreto 2591 de 1991.
- CUARTO. Por Secretaría, LÍBRESE la comunicación prevista en el artículo 36 del Decreto 2591 de 1991, para los fines allí contemplados.
