Derecho al minimo vital de persona que padece trastorno afectivo bipolar ansiedad y depresiones y que en virtud de la estructuracion de su invalidez decretada por la junta nacional de invalidez al considerar que esta se habia dado en abril de 2002 le niega el derecho a percibir la pension de invalidez que aduce se estructuro en 1997.

Solicita se establezca por parte de la junta nacional de invalidez como fecha de su invalidez el año 1997.

Hecho superado por la devolución de aportes realizados al fondo de pensiones en virtud de que no reunia los requisitos para que le fuera otorgada la pension de invalidez.

PRIMERO. LEVANTAR la suspensión de términos impuesta mediante auto del 2 de diciembre de 2005.
SEGUNDO. CONFIRMAR las sentencias proferidas por el Juzgado
Segundo. Civil Municipal de Pereira, el 24 de agosto de 2005, y el Juzgado
Cuarto. Civil del Circuito de Pereira, el 27 de septiembre de 2005 y, en consecuencia, por existir hecho superado, NEGAR la tutela al derecho al mínimo vital de la señora María Eugenia Builes Correa.
TERCERO. Para los efectos del artículo 36 del decreto 2591 de 1991, el juzgado de origen hará las notificaciones y tomará las medidas conducentes para el cumplimiento de esta sentencia.
