- PRIMERO. CONFIRMAR la sentencia del Juzgado 16 Penal de Circuito de Bogotá del 26 de septiembre de 2003, por los motivos expuestos en el presente fallo, y, en consecuencia, CONCEDER la tutela al debido proceso al señor José Miguel Ramírez León.
- SEGUNDO. DEJAR SIN EFECTOS la Diligencia 739 del 26 de junio de 2003, acta de amonestación en privado, proferida por el Departamento de Policía de Tisquesusa, Estación 1ª Usaquén, dentro de la querella policiva interpuesta por Luz Ángela Roa Rincón.
- TERCERO. Para los efectos del artículo 36 del decreto 2591 de 1991, el juzgado de origen hará las notificaciones y tomará las medidas conducentes para el cumplimiento de esta sentencia.
