Revisión de constitucionalidad del Decreto Legislativo 1278 del 31 de julio de 2023, por el cual se adoptan medidas de emergencia en materia cultural para la protección de la riqueza cultural del Pueblo Wayúu.
La norma que se revisa fue proferida en desarrollo del Decreto 1085 del 2 de julio de 2023, mediante el cual el Gobierno Nacional declaró el estado de emergencia económica, social y ecológica en el departamento de La Guajira.
Este Decreto fue declarado inexequible, con efectos diferidos por un año, a través de la Sentencia C-383/23.
En este fallo se dispuso que el diferimiento aplicaría respecto de la amenaza de agravamiento de la crisis humanitaria por la menor disponibilidad de agua.
La Sala Plena verificó que el Decreto analizado en esta oportunidad no guarda un vínculo temático con la atención de la referida amenaza y, por ello, lo declaró INEXEQUIBLE por consecuencia, con efectos inmediatos.
