Demanda de inconstitucionalidad contra el art. 280, numeral 8 (parcial) de la Ley 5º de 1992, “por la cual se expide el Reglamento del Congreso; el Senado y la Cámara de Representantes”.
El actor acusó un exceso normativo por parte del legislador porque no puede establecer una excepción al mandato general contenido en art. 179 de la Constitución.
La Corte evidenció que la normatividad demanda había sido objeto de pronunciamiento previo, por tanto, se configuró la cosa juzgada constitucional.
En consecuencia, declaró estarse a lo resuelto en la Sentencia C-093 de 1994, que declaró exequible la Ley 5º de 1992, art. 280, numeral 8.
