- Primero. Estarse a lo resuelto en la sentencia C-169 de 2004, expediente D-4758, que declaro exequible la parte demandada del inciso
- tercero. del articulo 5 de la Ley 643 de 2001, asi : "Declarar EXEQUIBLES las expresiones: "a los sorteos promocionales que realicen (...), los comerciantes o los industriales para impulsar sus ventas, las rifas para el financiamiento del cuerpo de bomberos, los juegos promocionales de las beneficencias departamentales y los sorteos de las sociedades de capitalizacion que solo podran ser realizados directamente por estas entidades", del tercer inciso del articulo 5deg de la Ley 643 de 2001."
- Segundo. Declarar exequible la expresion "los operadores de los juegos localizados", contenida en el mismo articulo 5 del inciso tercero, de la Ley 643 de 2001.
