Demanda de inconstitucionalidad contra el artículo 21 de la Ley 100 de 1993, por la cual se crea el sistema de seguridad social integral y se dictan otras disposiciones.
La disposición acusada se encarga de regular el método para calcular el ingreso base de liquidación de las pensiones de vejez.
Según el actor, esta norma contraviene los artículos 1°, 2°, 13, 42, 46 y 51 de la Constitución, porque genera una reducción notable en los ingresos de los trabajadores una vez se pensionan, lo cual a su vez desconoce la dignidad humana y el derecho al mínimo vital de éstos últimos y de sus núcleos familiares.
La falta de claridad, certeza, especificidad, pertinencia y suficiencia de los cargos propuestos llevó a la Corte a declararse INHIBIDA para emitir pronunciamiento de fondo.
