Demanda de inconstitucionalidad contra el artículo 222 (parcial) de la Ley 1819 de 2016, por medio de la cual se adopta una reforma tributaria estructural, se fortalecen los mecanismos para la lucha contra la evasión y la elusión fiscal y se dictan otras disposiciones.
Los demandantes aducen que la expresión cuestionada es incompatible con lo previsto en los artículos 13, 79, 80, 95 y 338 de la Constitución.
Solicitaron la declaratoria de inexequibilidad o, en su defecto, la exequibilidad condicionada, bajo el entendido de que el carbón sí está gravado con el Impuesto al Carbono y que le corresponde la tarifa que resulte de la aplicación de la fórmula contenida en el inciso primero del artículo demandado.
Dado que ninguno de los cargos planteados tiene aptitud sustancial, la Corte decidió declararse INHIBIDA para emitir pronunciamiento de fondo.
