Se confirmó la providencia de la Corte Suprema de Justicia que declaró la nulidad de todo lo actuado por el Tribunal Superior Militar, en relación con la tutela instaurada por el actor de la referencia.
La Corte Constitucional argumenta que la acción de tutela escapa el conocimiento de la justicia penal militar y aunque administra justicia lo hace pero de manera restringida, no sólo por los sujetos llamada a juzgar, sino por los asuntos de los cuales conoce.
Lo contrario, implicaría violar lo establecido en los artículos 213, inciso final y 221 de la Constitución.

CONFIRMASE, por las razones expuestas, la providencia de fecha catorce (14) de marzo de 1994, por la cual, la Sala de Casación Penal de la Corte Suprema de Justicia declaró la nulidad de toda la actuación cumplida por el Tribunal Superior Militar, en relación con la acción de tutela instaurada por Alberto Sarmiento Blanco.
- Segundo. COMUNIQUESE por la Secretaría General, la presente decisión al Tribunal Penal Militar de Santafé de Bogotá, D.C.
