Primero. REVOCAR PARCIALMENTE la sentencia proferida por el Juzgado 41 Civil del Circuito de Bogota, el 24 de mayo de 2002, dentro de la accion de tutela de la referencia, en cuanto hace relacion a Roque Antonio Gomez Garcia.
Segundo. CONFIRMAR la citada sentencia en lo que respecta a la Sociedad TPL - Tecnologie Progetti Lavori SPA En Liquidacion.
Tercero. En caso de una nueva investigacion administrativa por parte de la Superintendencia de Sociedades contra el fallecido Roque Antonio Gomez Garcia, y para efectos de la garantia del derecho de defensa, el mismo debe ser representado por sus sucesores conforme a la ley.
Cuarto. LIBRESE por Secretaria la comunicacion de que trata el articulo 36 del Decreto 2591 de 1991, para los efectos alli contemplados.
