- Primero. REVOCAR la sentencia proferida por el Juzgado
- Cuarto. Civil del Circuito de Villavicencio, el 16 de septiembre de 1998, dentro del proceso promovido por Fredy Enrique Ruiz Flórez en contra del Círculo de Suboficiales de las Fuerzas Militares, por las razones anotadas en la parte motiva de esta providencia.
- Segundo. ORDENASE al Círculo de Suboficiales de las Fuerzas Militares, desafiliar al señor Fredy Enrique Ruiz Flórez y suspender toda clase de descuentos en su contra en el término de cuarenta y ocho (48) horas, después de la notificación del presente fallo.
- Tercero. Dentro del mismo término, la entidad mencionada devolverá al demandante las sumas recaudadas por concepto de aporte de sostenimiento, a partir del momento en que recibieron en debida forma su solicitud de desafiliación.
- Cuarto. Líbrense por Secretaría, las comunicaciones de que trata el artículo 36 del Decreto 2591 de 1991.
