- Primero. CONFIRMAR el fallo proferido por el Juzgados
- Sexto. Civil Municipal de Ibagué.
- Segundo. ORDENAR a la Gobernación del Departamento del Tolima y a la Secretaría de Hacienda y Crédito Público de la mismas, que dentro del término de cuarenta y ocho (48) horas siguientes a la notificación de ésta providencia, cancele la mesada adicional adeudada al demandante, siempre y cuando exista partida presupuestal disponible. En caso de que no exista la respectiva partida, deberá realizar las operaciones presupuestales para garantizar las mesadas adeudadas. Dichas gestiones no podrán exceder el término perentorio de tres (3) meses.
- Tercero. PREVENIR a las entidades demandadas para que cumpla lo dispuesto en éste fallo, so pena de incurrir en desacato, y para que en lo sucesivo no repita la omisión que dió origen a la presente acción.
- Cuarto. Por Secretaría, líbrese la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
