- Primero. REVOCAR la sentencia proferida en el asunto de la referencia por el Juzgado Diecisiete Civil del Circuito de Santafé de Bogotá el quince (15) de julio de mil novecientos noventa y seis (1996).
- Segundo. CONCEDER la tutela del derecho fundamental de petición, y en consecuencia se ordena a la Caja Nacional de Previsión Social - CAJANAL, que en el término de 48 horas resuelva la petición de reconocimiento y pago de pensión de jubilación elevada por el señor Jairo Guaqueta Olarte.
- Tercero. COMUNICAR, por Secretaría General de la Corte Constitucional, el contenido de la sentencia al Juzgado Diecisiete Civil del Circuito de Santafé de Bogotá, para que sean notificadas las partes, de conformidad con lo dispuesto en el artículo 36 de decreto 2591 de 1991.
