- Primero. REVOCAR el fallo proferido por la Sala Octava de Decision Civil Familia del Tribunal Superior del Distrito Judicial de Barranquilla y, en su lugar, CONCEDER la tutela incoada por America Carbono Escorcia, en representacion de Emelina Carbono Escorcia.
- Segundo. ORDENAR al Ministerio de la Proteccion Social, Grupo Interno de Trabajo Gestion Pasivo Social Puertos de Colombia, que, si todavia no lo ha hecho, en el termino de cuarenta y ocho (48) horas, siguientes a la notificacion de esta sentencia, resuelva de fondo sobre la peticion elevada por la accionante y le notifique su decision.
- Tercero. Por Secretaria, LIBRESE la comunicacion prevista en el articulo 36 del Decreto 2591 de 1991, para los fines alli contemplados.
