- Primero. REVOCAR el fallo proferido por el Juzgado
- Tercero. Civil del Circuito de Cartagena el once (11) de febrero de mil novecientos noventa y nueve (1999), al decidir en segunda instancia acerca de la acción de tutela promovida por RAUL CASTILLA CASTILLA, contra el Alcalde Mayor de Cartagena y, en consecuencia, negar la protección solicitada.
- Segundo. ORDENAR que se dé estricto cumplimiento a lo ordenado en las Resoluciones 2844 de octubre de 1998 y 0053 de febrero de 1999, expedidas por el Alcalde Mayor de Cartagena, y que se restituya a los poseedores tradicionales la posesión que siempre han tenido sobre el predio "Guayepo", volviendo los hechos a su estado anterior.
- Tercero. El incumplimiento de lo aquí ordenado dará lugar a las sanciones previstas en los artículos 52 y 53 del Decreto 2591 de 1991.
- Cuarto. Por Secretaría, líbrese la comunicación de que trata el artículo 36 del Decreto 2591 de 1991.
