Primero. REVOCAR el fallo proferido por el Juzgado Diecisiete Penal Municipal de Bogotá, el 20 de diciembre de 2001, en el cual se negó la tutela del derecho de petición de Yackeline Elena Prieto Vergara y en consecuencia, TUTELAR su derecho de petición.
Segundo. ORDENAR al Ministerio de Hacienda y Crédito Público que, en el término de las cuarenta y ocho (48) horas siguientes a la notificación de este fallo, emita y pague al Instituto de Seguros Sociales el bono pensional correspondiente, si aún no lo ha hecho.
Tercero. ORDENAR al Seguro Social que, en el término de las cuarenta y ocho (48) horas siguientes a la emisión y pago del bono pensional por el Ministerio de Hacienda y Crédito Público, expida, si aún no lo ha hecho, el acto administrativo que resuelva de fondo la petición de la actora.
Cuarto. REMITIR al Juzgado Diecisiete Penal Municipal de Bogotá copia de la sentencia T- 684 de 2001, que resume la doctrina de la Corte Constitucional en materia de derecho de petición y bono pensional.
