- PRIMERO. CONFIRMAR parcialmente las sentencias proferidas por el Tribunal Administrativo de Cundinamarca, Sección Segunda -Subsección A, el día cuatro (4) de junio de mil novecientos noventa y tres (1993), y por el Honorable Consejo de Estado, Sala Plena de lo Contencioso Administrativo, el día veintiocho (28) de julio del mismo año, en cuanto negaron la tutela con respecto a las pretensiones del demandante, a las que se han hecho referencia en la parte motiva de esta providencia.
- SEGUNDO. Modifícanse las Sentencias mencionadas y conceder la tutela por violación del derecho fundamental de petición. En tal virtud, se ordena al FONDO DE AHORRO Y VIVIENDA Y VIVIENDA DISTRITAL - FAVIDI - resolver la petición elevada por MAURICIO SUAREZ RIVERA dentro del término improrrogable de cuarenta y ocho (48) horas, contado a partir de la notificación de esta sentencia, si para la fecha de esta última no ha sido resuelta la solicitud.
- Tercero. LIBRENSE por Secretaría las comunicaciones de que trata el artículo 36 del Decreto 2591 de 1991 para los efectos allí contemplados.
