- PRIMERO. Confirmar el fallo del Tribunal Superior del Distrito Judicial de Quibdo, pero modificandolo en el sentido de ordenar al Juzgado Promiscuo del Circuito de Riosucio suspender los efectos de la sentencia del 30 de julio de 1.991, hasta que el expediente correspondiente al proceso en que se profirio sea eventualmente reconstruido, se le notifique tal hecho a Guelmer de Jesus Yepes Martinez, y por cuatro meses mas, a fin de que pueda el afectado solicitar el cambio de su nombre, en caso de que ello sea necesario.
- SEGUNDO. Modificar la sentencia de instancia, ordenando remitir copia de esta providencia a la Registraduria Nacional del Estado Civil, para que la tenga como reemplazo de la certificacion que el Juzgado Promiscuo del Circuito de Riosucio no puede expedir, y proceda, con base en ella, a rehabilitar en forma definitiva a Guelmer de Jesus Yepes Martinez, identificado con la cedula de ciudadania No.70.063.399 expedida en Medellin, en el pleno ejercicio de sus derechos ciudadanos.
- TERCERO. Modificar la sentencia del Tribunal Superior de Quibdo, ordenando al Juez Promiscuo del Circuito de Riosucio que cancele la orden de captura proferida en contra de Guelmer de Jesus Yepes Martinez, y les de el aviso correspondiente a las autoridades a quienes oficialmente se les remitio.
- CUARTO. Confirmar la sentencia del Tribunal Superior de Quibdo en sus otros puntos.
- QUINTO. Comunicar la presente providencia al Tribunal Superior del Distrito Judicial de Quibdo, para los efectos del articulo 36 del decreto 2591 de 1.991.
