- en nombre del pueblo y por mandato de la Constitución,
- R E S U E L V E :
- Primero. CONFIRMASE en todas sus parte el fallo proferido el doce (12) de junio del presente año por el Consejo de Estado, Sala Plena de lo Contencioso Administrativo, mediante el cual, a su vez, fue confirmada la providencia de fecha cuatro (4) de mayo, pronunciada por el Tribunal Contencioso Administrativo del Chocó, al decidir acerca de la acción de tutela instaurada por el ciudadano JOSE LUIS MONTOYA AGUDELO contra el Departamento del Chocó .
- Segundo. Por la Secretaría, líbrense las comunicaciones de que trata el artículo 36 del Decreto 2591 de 1991 para los fines allí contemplados.
