- PRIMERO. Confirmar la decisión de Segunda instancia proferida por la Sala Penal del Tribunal Superior de Santafé de Bogotá por las razones expuestas en el presente fallo y, por lo tanto, no conceder la tutela impetrada.
- SEGUNDO. El Juez de primera instancia hará las notificaciones de que trata el artículo 36 del Decreto 2591 de 1991.
- TERCERO. Envíese copia de este fallo al Defensor del Pueblo a fin de que, dentro de sus funciones, desarrolle la labor de información para que los jueces no cometan la equivocación de conceder la impugnación en el efecto suspensivo, cuando se trata de fallos en la acción de tutela.
