El actor solicitó a Porvenir el reconocimiento y pago de su pensión de invalidez, pero la entidad, en lugar de resolver dicha petición, le solicitó a su ex esposa una copia del registro civil de nacimiento con nota marginal de nombramiento de curadora.
El accionante interpuso la acción de tutela alegando que dicho requisito no tenía sustento legal alguno, porque si bien sufrió un accidente en el que perdió su capacidad laboral, aún conservaba sus capacidades mentales.
En el trámite de revisión la Sala conoció del fallecimiento del titular de los derechos invocados y, en tal medida, decidió declarar la carencia actual de objeto por configurarse un DAÑO CONSUMADO.
