- PRIMERO. CONFIRMAR la sentencia proferida por la Corte Suprema de Justicia, Sala de Casación Civil, el dos (2) de junio de mil novecientos noventa y tres (1993), por las razones expuestas en la parte motiva de esta providencia. Por consiguiente, no se accede a la tutela presentada por la representante legal del menor PIER ANGELO CASTRO ORTIZ contra el Hospital Universitario del Valle Evaristo García, de Cali.
- SEGUNDO. Enviar copia del presente expediente al Instituto Colombiano de Bienestar Familiar, para que adopte las medidas pertinentes, de acuerdo con la parte motiva de esta sentencia, e informe a la Corte Constitucional sobre ellas. Las medidas deberán tener en cuenta el derecho del menor al mínimo vital.
- TERCERO. COMUNICAR la presente decisión al Tribunal Superior del Distrito Judicial de Cali, para que sea notificada a las partes, de conformidad con lo dispuesto en el artículo 36 del decreto 2591 de 1991.
