Primero. REVOCAR el fallo de segunda instancia de 19 de septiembre de 2000, dictado en el presente expediente por la Sala de Decisión Penal del Tribunal Superior de Santa Marta, que revocó el adoptado por el Juzgado
Primero. Penal del Circuito de Ciénaga (Magdalena) el 20 de junio del mismo año, mediante el cual se concedió la tutela impetrada contra el municipio de Zona Bananera.
Segundo. CONFIRMAR, en consecuencia, la sentencia de primera instancia ya reseñada, en cuanto resolvió tutelar los derechos fundamentales quebrantados por el municipio de Zona Bananera, y negó la acción respecto del municipio de Ciénaga.
Tercero. ORDENAR que por Secretaría General se dé cumplimiento a lo previsto en el artículo 36 del decreto 2591 de 1991.
