Primero. Confirmar el fallo proferido por Juzgado 27 Penal Municipal de Medellín en el proceso T-341924, mediante sentencia del dieciséis (16) de mayo de dos mil (2000).
Segundo. Revocar el fallo proferido por el Juzgado 18 Penal Civil del Circuito de Medellín en el proceso T-386661, mediante sentencia del tres (3) de agosto de dos mil (2000).
Tercero. Tutelar los derechos a la vida y la salud de Derian Hernando Carrillo Muñoz y en consecuencia ordenar a Colmena Salud E.P.S. que una vez realizada la notificación de esta providencia, le haga entrega de los medicamentos Indinavir y Conbivir.
Cuarto. Declarar que la E.P.S. Colmena Salud tiene derecho a repetir contra el Ministerio de Salud - Fondo de Solidaridad y Garantía, hasta el monto de los costos en que haya incurrido y que corresponden al Estado.
Quinto. Librar, por medio de la Secretaría General, las comunicaciones previstas en el artículo 36 del Decreto 2591 de 1991.
