- PRIMERO. REVOCAR la sentencia proferida dentro del expediente T-98265 por el Tribunal superior de Santafe de Bogota D.C. -Sala Laboral- y en consecuencia CONCEDER la tutela del derecho de peticion del senor Gerardo Rusinque Caldas, ordenando a que en el termino de cuarenta y ocho (48) horas, contadas a partir de la notificacion del presente fallo, el Instituto de Seguros Sociales de respuesta a la peticion formulada por el actor.
- SEGUNDO. COMUNICAR traves de la Secretaria General de la Corte Constitucional, el contenido de la sentencia al Tribunal Superior de Santafe de Bogota D.C. -Sala Laboral-, al Instituto de Seguros Sociales y al peticionario de la presenta accion de tutela.
