Vivienda digna.
Tutela contra providencia judicial.
La accionante instauró la acción de tutela, procurando que por esta vía se detenga el desalojo del inmueble que habita, el cual fue ordenado dentro de un proceso ejecutivo que concluyó con el embargo y posterior remate de la vivienda.
La actora alega que tiene la condición de madre cabeza de familia y que el inmueble objeto de remate está constituido como patrimonio de familia.
La Sala concluye que en el presente caso no se cumplen las condiciones de procedibilidad de la acción de tutela como mecanismo subsidiario de protección de los derechos fundamentales y que no se vulneró garantía alguna por el hecho de haber realizado el embargo y posterior remate del inmueble donde habita la actora.
