- Primero. REVOCAR la providencia del Tribunal Superior del Distrito Judicial de Santafé de Bogotá, Sala Penal, de fecha quince (15) de marzo de mil novecientos noventa y seis (1996). En consecuencia, tutelar el derecho de petición del Capitán Luis Alfredo Ramírez Sarmiento.
- Segundo. La Dirección General de la Policía, en el término de cuarenta y ocho (48) horas, después de ser notificada esta sentencia, deberá informarle al demandante que su solicitud de retiro se resolverá dentro de un plazo razonable, de acuerdo con las circunstancias de seguridad nacional o especiales de servicio.
- Tercero. COMUNICAR esta decisión al Juzgado 55 Penal del Circuito de Bogotá, para que sean notificadas las partes, de conformidad con lo dispuesto en el artículo 36 del decreto 2591 de 1991.
