  1. Primero. Revocar el fallo proferido por el Juzgado Quince Penal Municipal de Santiago de Cali, mediante el cual se negó la protección de los derechos invocados por la actor.
  2. Segundo. Conceder la protección de los derechos constitucionales fundamentales del actor, a la vida en relación con su mínimo vital y Ordenar al Alcalde del Municipio de Cali que, si todavía no lo ha hecho, en el término de las cuarenta y ocho (48) horas siguientes a la notificación de la presente providencia, proceda a cancelar las mesadas pensionales que se le adeudan al actor. De no ser posible su cumplimiento por razones netamente presupuestales o de manifiesta iliquidez, deberá informar al Juzgado Quince Penal Municipal de Cali en forma motivada, debiendo dentro del mismo término proceder a iniciar los trámites necesarios que deberán culminar con el pago en un término máximo de dos (2) meses.
  3. Tercero. Por Secretaría, líbrese la comunicación prevista en el artículo 36 del decreto 2591 de 1991.
