- Primero. REVOCAR el fallo proferido por la Sala Laboral del Tribunal Superior de Distrito Judicial de Cúcuta, que negó la protección invocada.
- Segundo. CONCEDESE la tutela del derecho de petición de CELINA MARIA PEÑARANDA VIUDA DE TORRADO y, en consecuencia, ORDENASE a la Caja Nacional de Previsión, CAJANAL, Seccional Norte de Santander, que, a más tardar dentro de las cuarenta y ocho (48) horas siguientes a la notificación de este fallo, resuelva de fondo sobre la solicitud por aquélla formulada.
- Tercero. ENVIESE copia del expediente y de esta providencia a la Procuraduría General de la Nación para lo de su cargo.
- Cuarto. DESE cumplimiento a lo previsto en el artículo 36 del Decreto 2591 de 1991.
