- Primero. REVOCAR la sentencia proferida por el Juzgado
- Tercero. Penal Municipal de Buenaventura, y en consecuencia TUTELAR los derechos a la vida y a la seguridad social del señor José Hernán Nieva. Se ordena al Alcalde de Buenaventura que en el término de cuarenta y ocho (48) horas siguientes a la notificación de esta sentencia, reanude el pago de las mesadas del actor, siempre y cuando exista partida presupuestal disponible. En caso contrario, deberá iniciar dentro de dicho plazo, los trámites pertinentes para cumplir con lo ordenado.
- Segundo. Líbrense las comunicaciones de que trata el artículo 36 del decreto 2591 de 1991.
