  1. Primero. REVOCAR el fallo proferido el 20 de mayo de 1999 por el Juzgado 52 Civil Municipal de Santa Fe de Bogotá, mediante el cual se negó la protección solicitada. En su lugar, se concede la tutela de los derechos a la igualdad, al habeas data, y el principio de la buena fe, en conexión con los derechos a la salud y a la seguridad social .
  2. En consecuencia, se ORDENA al Seguro Social que, si ya no lo hubiese hecho, dentro de las cuarenta y ocho (48) horas siguientes a la notificación del presente Fallo, proceda a autorizar que se practique al paciente la cirugía ordenada por la médica tratante, bajo la vigilancia científica y la responsabilidad profesional de ésta.
  3. Segundo. SE ORDENA al Seguro Social que actualice y rectifique la información que tiene del peticionario en la base de datos que esa institución lleva, con el fin de evitar que se vuelva a incurrir en hechos como los que dieron origen a la instauración de la acción de tutela en referencia.
  4. Tercero. ENVIENSE copias al Procurador General de la Nación para lo de su cargo.
  5. Cuarto. DESE cumplimiento a lo previsto en el artículo 36 del Decreto 2591 de 1991.
