- Primero. REVOCAR los fallos de instancia, que negaron la protección constitucional.
- En su lugar, CONCEDER el amparo invocado. En consecuencia, ORDENAR al Gerente de la Caja de Previsión Social Municipal de Bucaramanga, que , si ya no lo hubiere hecho, proceda, dentro de las cuarenta y ocho (48) horas siguientes a la notificación del presente fallo, al pago indexado de las cesantías reclamadas por el actor y a él ya reconocidas.
- Si, por la imprevisión administrativa, no hubiere partida presupuestal disponible, las cuarenta y ocho(48) horas se conceden para que, bajo la vigilancia del juez de primera instancia, se inicien y culminen los trámites correspondientes, con miras a cumplir con lo ordenado, todo lo cual no podrá exceder del término de un (1) mes.
- Segundo. Por Secretaria, LÍBRESE la comunicación prevista por el artículo 36 del Decreto 2591 de 1991.
