- Primero. REVOCAR la sentencia proferida por el Juzgado
- Sexto. Laboral del Circuito de Barranquilla. En su lugar, TUTELAR el derecho de libre asociación
- Segundo. ORDENAR a la E.S.E. Hospital de Baranoa, para que en el plazo máximo de cuarenta y ocho (48) horas, contadas a partir de la notificación de la presente sentencia, proceda, si aún no lo ha hecho, a entregar a la Asociación Nacional de Enfermeras Certificadas "ANDEC", Seccional Atlántico, todas las cuotas sindicales indebidamente retenidas y que fueron descontadas a las veinte (20) enfermeras que laboran en dicho hospital y que se encuentran afiladas a dicha asociación.
- Tercero. El incumplimiento de las ordenes aquí impartidas, dará lugar a las sanciones que por desacato establece el artículo 52 del decreto 2591 de 1991.
- Cuarto. Por Secretaria General, líbrese la comunicación de que trata el artículo 36 del decreto 2591 de 1991.
