PRIMERO. CONFIRMAR PARCIALMENTE la sentencia del Juzgado 1º Penal Municipal de Bucaramanga del 29 de octubre de 2002 y en consecuencia negar la tutela al derecho a la salud en conexidad con la vida del señor Ernesto Calderón Ramírez, en los términos expuestos en esta sentencia.
SEGUNDO. ORDENAR al Hospital Ramón González Valencia que en el término de cuarenta y ocho horas (48) posteriores a la notificación de la presente sentencia atienda a través de médicos oftalmólogo y neurocirujano al señor Ernesto Calderón Ramírez. Una vez determinado por los médicos tratantes los procedimientos o medicamentos óptimos para la atención de la salud del paciente, realizar lo dispuesto por éstos en el mínimo tiempo requerido, según su concepto.
TERCERO. ORDENAR al Juzgado 1º Penal Municipal de Bucaramanga que vigile el cumplimiento de la presente sentencia.
CUARTO. Para los efectos del artículo 36 del decreto 2591 de 1991, el juzgado de origen hará las notificaciones y tomará las medidas conducentes para el cumplimiento de esta sentencia.
