Primero. Confirmar la sentencia proferida por el Juzgado 9 Penal del Circuito el 29 de agosto de 2000, por medio de la cual se negó la tutela solicitada por Joaquín Romero Herrera, pero por la carencia actual de objeto que se produjo en este caso por cesación de la actuación impugnada.
Segundo. Prevenir a la Superintendencia Bancaria para que, en el ejercicio de competencias discrecionales como aquella que dio origen a este proceso, se atenga a los límites que en esta providencia se le han señalado, so pena de las sanciones previstas en el Decreto 2591 de 1991 para el desacato.
Tercero. Por Secretaría, líbrese la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
