- Primero. REVOCAR el fallo proferido por el Juzgado dieciséis (16) Civil Municipal de Cali el 24 de agosto de 2001, y en su lugar denegar el amparo solicitado por JOAQUÍN ALONSO HENAO MOSQUERA en la demanda de tutela que instauró contra el municipio de Santiago de Cali.
- Segundo. Por Secretaría, líbrese la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
