en nombre del pueblo y por mandato de la Constitucion,
R E S U E L V E :
PRIMERO. REVOCAR la Sentencia proferida por el Juzgado 13 Penal del Circuito de Barranquilla, por las razones expuestas en esta sentencia.
SEGUNDO. CONFIRMAR la Sentencia proferida por el Juzgado 9 Penal del Circuito de Barranquilla, concediendo la tutela solicitada por el senor Gilberto Raul Marriaga Robles por la vulneracion del derecho de peticion consagrado en el articulo 23 de la Constitucion Politica, por las razones expuestas en esta sentencia.
TERCERO. ORDENAR a la Fiscalia Regional de Barranquilla que en el termino de cuarenta y ocho (48) horas de respuesta por escrito al peticionario de la tutela acerca de el tramite que ha dado a sus peticiones.
CUARTO. COMUNICAR a traves de la Secretaria General de la Corte Constitucional el contenido de la sentencia al Juzgado 13 Penal del Circuito de Barranquilla, al Juzgado 9 Penal del Circuito de Barranquilla y al peticionario de la presente tutela.
